Overview and Scope of This Agreement

Webster Kitchen and Bath has been remodeling kitchens and bathrooms in Reading for decades, and we have learned that most problems start with a vague contract. We put everything in plain English so you know exactly what you are getting before a single cabinet comes off the wall. This agreement covers every kitchen and bath remodeling project we perform in Reading and throughout Berks County.

By signing a project contract with Webster Kitchen and Bath, you agree to these terms. They apply to every homeowner and every project before any work begins. No exceptions.

Pennsylvania Contractor Licensing and HICPA Compliance

Webster Kitchen and Bath operates under the Pennsylvania Home Improvement Consumer Protection Act (HICPA). This covers all residential remodeling contracts valued at $500 or more and protects consumers throughout the process. Our PA Home Improvement Contractor registration number appears on every written contract we issue.

HICPA protections apply to all homeowners in Reading and throughout Berks County. You have the right to a written contract before work begins. Cancellation rights too.

3. Services Performed and Scope Limitations

We handle kitchen and bathroom remodeling, cabinetry, tile, fixtures, and related finish work. Everything we perform is listed in your signed project contract.

Anything not explicitly listed in your contract sits outside the scope of this agreement and is not included in your quoted price. Want something added? We put it in writing before proceeding. Webster Kitchen and Bath does not perform structural engineering, HVAC system work, or electrical panel upgrades unless your contract specifically states otherwise.

4. Payment Terms, Deposits, and Refund Policy

A deposit is required before we schedule your project. The exact amount and full payment schedule appear in your signed project contract. Progress payments are due at milestones defined in that same contract, and final payment is due upon completion.

Deposit Policy
Deposits are non-refundable once materials have been ordered or work has started. If you cancel your project, any refund amounts and cancellation terms will be defined in your individual contract.

5. Change Orders and Scope Changes After Contract Signing

Changes require written change orders. Both you and a Webster Kitchen and Bath representative must sign before we proceed. Verbal agreements don't count.

Change orders may affect your total project cost and completion date. We walk you through exactly what changes and why before anyone signs anything.

Important Notice
Verbal agreements to change the scope of work are not binding. We will not honor them without a signed written change order.

It happens all the time. You see the kitchen open up and decide you want a different layout. Just tell us. We write up the change order, show you the cost, and get your signature before the crew adjusts anything. Clean and simple.

6. Unforeseen Conditions in Existing Construction

Reading has lots of older housing stock. The row homes along Penn Street, the historic districts near City Park, and the older neighborhoods throughout the city were mostly built before 1950. When we open up walls, floors, or ceilings in these places, surprises emerge. Invisible things. No one could see them before demolition started.

Hidden Conditions May Include
Knob-and-tube wiring, outdated galvanized plumbing, substandard framing, mold, or asbestos-containing materials. These are not part of your original project scope. If we find something like this, work stops in that area until we talk to you directly.

We explain what we found, what needs to happen, and what it costs. No work proceeds without your written approval.

7. Permits, Inspections, and Municipal Delays

We pull all required permits for work covered under Reading city and Berks County building codes. You don't navigate the bureaucracy yourself.

Permit Delays
Project schedules depend on permit review timelines set by the City of Reading or Berks County permitting offices. Those review periods are outside our control. We cannot speed up a municipal office, and schedule changes caused by permit delays are not our responsibility.

You are responsible for providing home access during normal business hours when inspections occur.

Most Reading homeowners have never pulled a building permit in their lives. You should not have to figure it out now. We file the paperwork, track the status, and schedule the inspections. You just need to be home when the inspector shows up.

8. Warranties

Webster Kitchen and Bath warrants our workmanship for the period stated in your individual project contract. Warranty terms vary by project type, so review your contract carefully. Manufacturer warranties on materials, fixtures, cabinetry, and appliances are separate and governed by each manufacturer's own terms.

Protect Your Warranty Coverage
Warranty coverage is void if you or a third party modifies, misuses, or damages the completed work. Follow the maintenance recommendations provided at project completion to keep your coverage intact.
Questions About What Your Warranty Covers?
Warranty language in remodeling contracts can be confusing. If you want someone to walk you through what is covered before you sign, that is a reasonable request. We do it all the time.

9. Limitation of Liability

Our liability is capped at what you paid. We're not liable for indirect, incidental, or consequential damages. No loss of use, temporary housing costs, or lost income.

Pennsylvania Law Protections
Nothing in this agreement limits liability for claims arising from gross negligence or willful misconduct as defined under Pennsylvania law.
